The Asian Human Rights Commission (AHRC) has received information regarding the case of violence against Mr. Ali Nurdin, the chairperson of Gempur, a non-governmental organization (NGO), in Pariaman Lima Koto Kampung Dalam sub-district, Padang Pariaman regency, West Sumatera province. Nurdin was brutally attacked after filing a police report against the misuse of funds allegedly involving the Genius Foundation, which belongs to the Pariaman Vice Mayor. Despite Nurdin having reported the case to the police, until today the investigation has not produced significant progress, and the victim remains unprotected.

CASE NARRATIVE:

On 3 April 2017, Ali Nurdin filed a report to the Pariaman Police Office (Polres Pariaman) against a foundation established by the Pariaman Vice Mayor, Mr. Genius Umar, involved in the misuse of funds allocated by the Minister of Education. Nurdin also reported allegations of falsifying documents related to the development the Genius Global Madani School, which also belongs to the Vice Mayor. The police are still conducting an investigation and have not announced any final investigation result. With regard to the case of falsifying documents, the police investigator decided to suspend the investigation as the case took place in a difference province.

Subsequently, on April 29, Nurdin was phoned by an unknown person who introduced himself as Mr. Anton. On the phone, Anton invited Nurdin to discuss some cases and Nurdin accepted. The next day, Nurdin received a call from a different phone number, and he was invited to come to the Manggung bridge, North Pariaman sub-district, Pariaman city. When Nurdin reached the bridge and parked his motorcycle, he was suddenly attacked by an unknown man. Without any conversation, the man swung a samurai at Nurdin’s neck, and spontaneously Nurdin parried with his right hand. As a result, Nurdin’s right wrist broke, while the assailant escaped on his motorcycle (Yamaha Nuvo).

While this attack is being investigated by the Pariaman Police Office, the police investigators are still looking for witnesses for further testimony. Nurdin has undergone medical treatment and routine physiotherapy in the Pariaman public hospital.

The AHRC has been informed that there is a strong indication that the attack against Nurdin is related to his advocacy effort to uncover the alleged misuse of funds and falsifying identity conducted by the foundation belonging to Vice Mayor Mr. Genius Umar.

SUGGESTED ACTION:

Please write to the authorities listed below. Ask them to ensure that the brutal attack against Mr. Ali Nurdin is seriously investigated. The police investigators must uncover the nexus between the alleged perpetrator, Genius foundation and the Pariaman Vice Mayor. Moreover, the police investigators should continue the investigation of the alleged misuse of funds in the development of Genius Global Madani School. In addition, we also respectfully request the Corruption Eradication Commission (KPK) and the Victims and Witness Protection Agency (LPSK) to monitor the case and ensure protection for the victims and the witnesses.

The AHRC will write a separate letter to the UN Special Rapporteur on Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment and Special Rapporteur on the situation of human rights defenders calling for their intervention in this matter.
