UP-125-2005: INDONESIA: President and Parliament must audit the police investigation performance in Munir’s case

Dear friends,

The Asian Human Rights Commission (AHRC) again calls for your strong support in the murder case of Munir, the prominent human rights activist in Indonesia.

Despite strong and constant demand from the local human rights groups, the presidential fact finding team (TPF)’s report which had been submitted to President Susilo Bambang Yudoyono on 23 June 2005 has not yet been released to the public.

In addition, there is still no progress of the investigation into Munir’s murder conducted by the police investigation team, which was formed as soon as the TPF’s mandate had been completed in this June. Even though the findings of the TPF suggested the involvement of high-ranking intelligence officials and senior employees of the Garuda airline in Munir’s death, there has been no investigation of those people. As a result, no prosecution has been made against them except Pollycarpus, a Garuda pilot and the major suspect in Munir’s murder.

Meanwhile, several hearings of the trial against Pollycarpus (Case No. 1305/JKT.PST/07/2005) were held at the Central Jakarta District Court in September and up to now. About 20 persons, mainly air crews of Garuda Airlines, have testified. However, none of them have clearly established that Pollycarpus was involved in Munir’s killing.

In light of the above, we urge you to write to the President of Indonesia and Chairperson of Parliament requesting them to audit the police investigation performance in Munir’s case. Please also urge them to appoint a special independent monitoring body to observe the conduct of the police investigation.

The AHRC also calls to all concerned groups and persons to attend the trial of Munir’s murder (the trial against Pollycarpus) as observers. The trial is being held every Tuesday and Friday from 9:00 am, at the Central Jakarta District Court, 3rd floor, room 1, Jl. Gajah Mada Jakarta Pusat, Indonesia.

I am gravely concerned about the lack of progress of the police investigation in the murder case of the human rights activist Munir. 

Already four months have passed since the police investigation team had been established however there has been no progress in the investigation up to now. In particular, there has been no investigation of high-ranking intelligence officials and senior employees of the Garuda airline, even though the findings of the presidential fact finding team (TPF) suggested their involvement in Munir's murder. As a result, no prosecution has been made against them except Pollycarpus, a Garuda pilot who is the major suspect of Munir's murder. 

This delay raises questions as to whether the police investigation team has strong will to find the truth of Munir's murder and bring the responsible persons to justice.   

I therefore urge you to intervene in this matter. Please take appropriate action to speed up the investigation and ensure its accountability. I also urge you, with the cooperation of the Parliament, to audit the police investigation performance into Munir's case. I further urge you to release a final report of the presidential fact finding team to the public and submit its findings to the police investigation. Lastly, I request you to ensure that the process of the trial related to Munir's case is duly and fairly conducted.
