The Asian Human Rights Commission (AHRC) has received updated information provided by the Land Reform Commission (KPA), a national NGO documenting land conflicts,regarding the current legal status of three residents of Sukamulya Village, Kertajati Sub-district, Majalengka Regent, West Java Province. They were detained on17 November 2016 and have finally just been granted bail.

UPDATED INFORMATION:

On November 24, West Java regional police (Polda Jawa Barat) finally released on bail the three residents of SukamulyaVillage who had been in detention since November 17.

The three villagers had been detained because they fought and opposed land measurement for the proposed international airport development.Still, followingthe chaos and attacksperpetrated by the police and military, many Sukamulya villagers are suffering from trauma and psychological problems, in particular women and children. Ever since the local government deployed numerous police officers in the area many villagers are afraid to go back to their respective houses.

Despite the National Commission on Human Rights (Komnas HAM) having conducted field monitoring, there is no clear information about the result of this monitoring and whether there will be an investigation into the actions of the security forces thatappear to have committed violence and attacked the Sukamulya villagers. There is no clear information about the remedy for Sukamulya villagers who experienced violence during the land measurement exercise.

SUGGESTED ACTION:

Please write to the authorities listed below, asking them to ensure that the local government of Majalengka Regent and West Java Province, as well as the police, stop any form of criminalization of villagers inSukamulya. The local government should provide adequate compensation to the local residents and help the villagers recover from the trauma they are suffering. The government should ensure protection to villagers and guarantee that such traumatic attacks by State personnel do not recur in the future.

The AHRC is writing separate letters to the UN Special Rapporteur on the Right to Food and Special Rapporteur on the promotion and protection of the right to freedom of opinion and expression calling for their intervention into this matter.

The government should ensure protection to villagers of Sukamulya and guarantee the same kind of heavy-handed actions do not recur.
