NEPAL: CPA’s Human Rights Commitment and Reality

NEPAL: CPA’s Human Rights Commitment and Reality

Government of Nepal and the then CPN-Maoist while signing the Comprehensive Peace Agreement on November 21, 2006, had pledged to established sustainable peace and democracy in Nepal. However, we have felt that both sides are ignoring the commitments made in the CPA and that is leading the country to the abyss. This has also resulted in deprivation of people’s economic and social rights and also their right to transitional justice.

Peace process of Nepal is being viewed with uncertainty and suspicion because of the doubt over promulgation of the new constitution on extended deadline due to widening mistrust among the political parties, lack of implementation of crucial understandings and agreements, expiration of CA’s original deadline of two years and extension by one year and lack of understanding among the political parties.

There is no substantial improvement in the important issues as deciding on the future of the Maoist combatants, establishing different commissions including Commission on Disappeared Persons, Truth and Reconciliation Commission and State Restructuring Commission as mentioned in the Interim Constitution and no return of properties captured by the rebels during the insurgency.

Therefore, for the sake of sustainable development and institutional development of democracy along with proper management of transitional justice

We would like to draw the attention of the government and the political parties on following issues:

• for timely promulgation of the constitution
• for effective implementation of the CPA
• for establishment of Truth and Reconciliation Commission and Commission on Disappeared Persons
• for ensuring fearless environment for the persons active in the field of fundamental rights including freedom of opinion and expression and human rights
• for immediately addressing the rampant state of impunity
• for ensuring social justice of the Nepalis by enshrining the economic, social and cultural rights for sustainable peace and development
• for ending criminalization of politics and politicization of crimes
